Special Education: Procedures for Sending Age of Majority Forms

Age of Majority forms must be sent to all students at age 17 and again at age 18.

When a returning student turns 17 years of age, LMACS will give a copy of the Age of Majority Notice and a copy of the Notice of Procedural Safeguards to both the student and the parents. The forms are to be printed out from Esped (pages 1-3) and mailed home. If a Team meeting is scheduled within a few months of the student’s 17th birthday, the forms may be distributed at the meeting.

Note: All IEPs must state in “Other Information” one of the following statements:

  • (Student’s name) has been provided a copy of the PNPS 

and has been informed that when they are 18, they will have all of the rights that their parent has now under the special education law.

Or

  • LMACS has provided (Student name) with a copy of the PNPS and has explained the transfer of special education rights that will occur when (student) is 18 years of age.

When a student turns 18 years of age, the Director of Special Education  will print out all four Age of Majority forms from Esped. The student must sign the Age of Consent Decision form within one week of their birthday (except when the birthday falls during the summer recess). A Team member and a witness must also sign the form. In addition, all forms are to copied and sent to the parent and returned to the special education department with both parent and student signatures. Both parent and student are to receive the PNPS.

If a student transfers to LMACS after their 18th birthday, all four pages of the Age of Majority forms are to be presented as soon as possible. Copies must be given to both student and parent.
